What is a will?
A will or testament is a legal document by which a person, the testator, expresses their wishes as to how their property is to be distributed at death, and names one or more persons, the executor, to manage the estate until its final distribution.
Do you need a will if you have a living trust?
Yes. A “pour-over” will is important to include with your estate plan in addition to a living trust. The our over will is so called because it “pours over” into the trust anything of value not already in the trust at the time of death. Examples of such assets would be your automobile and checking account.
When we prepare a living trust for you, we also prepare a pour over will at no additional cost.
